Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and Sammons Consulting LLC, doing business as Crash Science (“Crash Science,” “we,” “us,” or “our”), governing your access to the Crash Science website, member application, 3D vehicle database, case workspace, reports, and related services (the “Service”). By creating an account, accepting an invitation, purchasing a membership, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you use the Service for an organization, you represent that you are authorized to bind that organization.

2. Eligibility and accounts

You must be at least 18 and legally able to enter this agreement. Provide accurate information, keep it current, protect your credentials, and promptly notify us of suspected compromise. Accounts and seats are assigned to named users and may not be shared. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.

3. Memberships, renewal, and cancellation

Paid memberships are billed monthly or annually as shown at checkout. Unless canceled, a membership automatically renews at the end of each billing period, and you authorize the applicable recurring charge. Prices, taxes, billing frequency, seat quantity, and renewal date are displayed before purchase. We may change future pricing with advance notice; a change applies no earlier than the next renewal permitted by law.

You may cancel renewal through the billing portal or another cancellation method we provide. Cancellation takes effect at the end of the then-current paid period unless we expressly state otherwise; access ordinarily continues through that date. Except where required by law or expressly offered by Crash Science, charges are nonrefundable and we do not provide prorated refunds for unused time. Canceling a subscription does not automatically delete saved cases or your account.

4. Taxes and payment providers

Prices may exclude applicable sales, use, value-added, or similar taxes. You are responsible for taxes that the law requires you to pay, excluding taxes on our net income. Payments are processed by Stripe under its terms and privacy notice. We may suspend paid features after a failed payment, chargeback, or overdue balance, subject to required notice and applicable law.

5. Team workspaces and named seats

A Team membership covers the purchased number of named users, up to the displayed plan limit. The workspace owner controls billing and may appoint administrators. Authorized Team owners and administrators may invite, assign roles to, suspend, remove, and replace users within their permissions. A billing administrator manages billing only. A Team administrator does not automatically receive access to every customer case; case access is limited as shown in the Service. Your organization is responsible for its users and for maintaining appropriate seats, permissions, and case assignments.

6. Limited license to use the Service

Subject to these Terms and your active authorization, Crash Science grants you a limited, nonexclusive, nontransferable, non-sublicensable right to use the Service for your internal professional work. Crash Science and its licensors retain all rights in the Service, software, interfaces, vehicle-model files, graphics, databases, documentation, and related materials that are not expressly granted here.

7. Vehicle models and controlled access

The Service provides session-based browser access to vehicle models and does not provide a direct model-download feature. You may inspect models and incorporate permitted views and measurements into your professional work and issued reports. You may not extract, scrape, copy, download by circumventing controls, reverse engineer, redistribute, resell, sublicense, publish, train a model on, or create a competing vehicle-model library from the model files or protected database content. You may not bypass stream tickets, access controls, usage limits, or other safeguards.

8. Calibration, measurements, and professional judgment

A “Scale verified” label means Crash Science recorded two selected endpoints, an Owner Admin-confirmed known distance and unit, a verifier, a verification date, and an exact model version. The audit label is generated automatically from those recorded facts. It does not mean every point, surface, component, or dimension of the model has been independently surveyed. Vehicle geometry, condition, modifications, scan artifacts, and reference data can affect results.

The Service is a professional visual-reference and measurement aid. It does not replace a certified survey, manufacturer dimension data, physical inspection, scene documentation, expert analysis, engineering judgment, or compliance with evidentiary rules. You must independently evaluate fitness and verify any dimension material to an opinion, claim, filing, or testimony.

9. Cases and customer content

You retain your rights in case information, measurements, notes, marked areas, and other content you submit (“Customer Content”). You grant Crash Science a limited license to host, process, reproduce, and display Customer Content only as needed to operate, secure, support, and improve the Service, comply with law, and enforce these Terms. You represent that you have lawful authority to upload and process Customer Content and that doing so does not violate confidentiality, privacy, intellectual-property, court, insurer, employer, or client obligations.

10. Issued reports and integrity records

An issued report is a versioned PDF generated from the case and vehicle state recorded at issuance. Crash Science stores the associated model version, calibration reference, timestamp, evidence snapshot, and integrity hashes. A hash can help detect whether a file or snapshot changed after issuance; it does not independently prove that source facts, inputs, interpretation, or conclusions are correct. Issued reports are not editable in place. A later issuance creates a new version and does not erase earlier versions.

11. Acceptable use

You may not use the Service to violate law or another person’s rights; upload malware or unlawfully obtained material; probe, disrupt, overload, or circumvent security; share credentials; impersonate another person; access a case or model without authorization; misstate a model’s verification status; remove notices; automate extraction; or use the Service in a way that threatens its integrity, availability, licensors, or customers.

12. Suspension and termination

We may limit or suspend access when reasonably necessary to address a security incident, suspected credential or model theft, unlawful or abusive use, unpaid charges, material breach, provider requirement, or risk to the Service or others. When practicable, we will give notice and an opportunity to resolve the issue. Serious or urgent misuse may require immediate action. Suspension of access does not itself cancel renewal unless we or you separately cancel the subscription. You may stop using the Service at any time.

13. Service changes and availability

We may add, change, retire, or temporarily remove features and vehicle records, including to correct quality, licensing, security, or reliability concerns. Historical case-pinned records may remain available where supported, but we do not promise uninterrupted availability or permanent coverage of a particular vehicle. Maintenance, provider failures, emergencies, or events outside our reasonable control may interrupt access.

14. Third-party services

The Service depends on third-party providers such as hosting, authentication, storage, email, and payment services. Your use of third-party features may also be subject to their terms. Crash Science is not responsible for an independent third-party service outside our control, but we remain responsible for our own obligations under these Terms and applicable law.

15. Feedback

If you provide suggestions or feedback, you grant Crash Science a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” CRASH SCIENCE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY MODEL, DIMENSION, CALIBRATION, REPORT, OR RESULT WILL BE ERROR-FREE, COMPLETE, OR SUITABLE FOR A PARTICULAR MATTER. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRASH SCIENCE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS, OR USE, ARISING FROM OR RELATED TO THE SERVICE. CRASH SCIENCE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE FEES YOU PAID TO CRASH SCIENCE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

18. Indemnification

To the extent permitted by law, you and the organization you represent will defend, indemnify, and hold harmless Crash Science and its personnel from third-party claims and reasonable costs arising from your Customer Content, unlawful or unauthorized use, violation of these Terms, or infringement of another person’s rights. This obligation does not apply to the extent a claim results from Crash Science’s own breach, gross negligence, or willful misconduct.

19. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Subject to any nonwaivable right, the state and federal courts serving Pinal County, Arizona will have exclusive jurisdiction, and each party consents to that venue. Before filing a claim, each party will make a good-faith effort for at least 30 days to resolve the dispute through written notice. Nothing prevents either party from seeking urgent injunctive relief for security, confidentiality, or intellectual-property misuse.

20. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised version and effective date. If a material change requires renewed agreement, we will ask you to accept the new version before continuing. Changes do not retroactively alter an issued report or accrued payment obligation unless required by law.

21. Electronic communications and general terms

You consent to receive agreements, notices, invoices, and service communications electronically. If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a business transaction. These Terms, the Privacy Policy, and any checkout terms are the complete agreement regarding the Service and supersede prior statements on the same subject.
